Scottish Gymnastics have been working with Morton Fraser as our legal advisors for the past year. We are delighted to be renewing the partnership and entering year two of the agreement with them. Whilst the first year of the partnership focused on legal status for clubs this next year will see advice offered over a more diverse range of topics.
Paul Geoghan, Senior Associate at Morton Fraser, said: "We are delighted that Scottish Gymnastics has renewed our appointment as an approved legal adviser to member clubs of Scottish Gymnastics for a further year. Over the last 12 months, we have worked closely with Scottish Gymnastics to support member clubs who have been considering changing their legal status. This work has included presenting seminars in Aberdeen, Edinburgh and Glasgow as well as the preparation of legal toolkits to assist member clubs seeking to incorporate as a company limited by guarantee or as a Scottish Charitable Incorporated Organisation (SCIO). In the next 12 months, our focus will be on providing member clubs with guidance on a number of matters such as data protection, governance and property. We will also continue to be available to assist member clubs with any legal issues which they may have".
It is recognised that a large percentage of our member clubs are unincorporated associations and perhaps unaware of the risks and liabilities that legal status brings. As such, in partnership with Morton Fraser, 2016 saw us host a number of seminars to raise awareness with clubs of legal status options. Off the back of the workshops Morton Fraser have been supporting a number of clubs with reviewing and changing their status. In order to help clubs with this transition two legal toolkit documents have now been produced which talk a club through the step by step process of incorporation either as a SCIO (Scottish Charitable Incorporated Organisation) or a Company limited by guarantee and offer templates of all the paperwork needed to accomplish a change in status.

The toolkits have been designed to assist member clubs who wish to incorporate as a company limited by guarantee (without charity status) or as a Scottish Charitable Incorporated Organisation (SCIO). Whilst the documents included within the toolkits are templates, and may not therefore cater for every club's specific circumstances, it is hoped that they provide a helpful starting point for member clubs and facilitate discussion on key issues relating to any proposed incorporation".
